The real estate agent will help you to estimate the sale price of your property.
You will then sign with him a mandate of sale specifying :
- The contact details of the agency
- The contact details of the vendor and owner
- The address of the property for sale
- The description of the property
- The registry references in the property register
- The vendor's asking price
- The agency commission which will be added to your price to obtain the sale price posted in the window and on Espace casa
- The duration of the contract
The real estate agent will then need to make photographs of your property which will be used on Espace casa to sell it as quickly as possible and under the best conditions.
Once the purchaser has been found, you will sign a preliminary contract committing you to reserve your property with this customer.
The following will be well specified in this contract :
- Contact details of the purchasers and vendors
- Description of the property and the references in the register
- Amount of the deposit to reserve the property. This sum must be completely or partially paid to you
- Choice of a maximum date for carrying out the final act of transfer
It has to be known that if the purchaser has the funds, it is possible to sign the definitive deeds at the notary's one week after the reservation.
For this, the real estate agent will have taken care to collect all the documents necessary for the sale. He will organise the date of signature and will approach banks if there are mortgages to be repaid.
At the notary's, you must request the presence of a person speaking your own language. It is common for the Spanish notary to speak English and French.
You will only sign the final sale when you have received all of your money.
According to law, 3% of your sale price indicated on the deeds will be held back from you. This will constitute a provision on the capital gains which you will have to pay. This calculation will be made by a 'gestor'.
You will also have to pay the council tax, calculated according to several criteria and in particular the cadastral value and the time you have been the owner. This tax corresponds on average to a few hundred euros.
The real estate agent will then take care of the changes of electricity, water and gas meters into the name of the new owner.
